Colombia has moved from sandbox to a functional regulatory structure: a registry of Virtual Asset Service Providers supervised by the Superintendencia Financiera and — the 2026 move — authorisation for supervised entities such as trust companies and banks to offer crypto custody. For tokenization, the countrys natural vehicle is the fiducia mercantil.
The framework: SFC and the PSAV registry
The Superintendencia Financiera oversees the PSAV registry, requiring exchanges, wallets and custodians to register and meet legal and technical standards. Regulation does not prohibit crypto-assets: it requires operating under supervision. And from 2026, supervised trust companies and banks may custody crypto-assets — the institutional piece that was missing for tokenization structures with first-tier custody, as we explain in our crypto-asset custody guide.
Fiducia mercantil: the Colombian vehicle
Tokenization projects — Colombian proptech being the living example — are structured on the fiducia mercantil: SFC-supervised trust companies administer the autonomous estate and the fiduciary rights are represented in tokens. It is the local variant of the Latin American fideicomiso, backed by one of the regions most developed trust industries. What is still missing is a specific tokenization statute — serious projects operate by structuring well, not by waiting for the perfect rule.
What is being tokenized
Real estate first (housing fractions and developments), with credit and agriculture as the next frontiers. The read for an issuer: the gap is doing it to securities-market standards — transfer restrictions, supervised custody, investor information — before specific regulation demands them.
