Asset tokenization in Bolivia: the Central Bank turn of 2024, ASFI and the trust

In 2024 Bolivia went from banning crypto-assets to allowing operations with them through regulated channels: Central Bank Resolution 082/2024 opened the door that had been closed since 2020. It is not a tokenization law, but it changes the starting point: what could not even be intermediated before now goes through the supervised financial system.

The framework: BCB, ASFI and the 2024 opening

The Central Bank of Bolivia authorised financial intermediaries to channel virtual-asset operations — without legal tender status and with an express risk warning — and ASFI supervises both the financial system and the securities market under Law 393 and the Securities Market Law. A tokenized security is a security: registration with ASFI, a brokerage and investor information. Crypto use has multiplied since the opening; provider-specific regulation is still being built.

The vehicle: the Bolivian trust

The trust of the Commercial Code and Law 393, with financial institutions as trustees, and the securitisation companies supervised by ASFI are the Bolivian variant of the Latin American fideicomiso: autonomous estate, regulated trustee and securities issued against it, which can be represented in tokens.

What is being tokenized

A market that is just starting: real estate in Santa Cruz and La Paz, agribusiness and mining as assets with financing demand, and a population that adopted crypto payments quickly after the opening. The reading for an issuer: demand exists and so does the vehicle; the provider framework is young and it pays to structure to securities standards ahead of the rule.
