What DAC8 is: the EU directive requiring crypto-asset platforms to report to the tax authority and to share that data between EU countries.

What is it? - Dummies

Until recently, the tax authority found it hard to know what crypto each person was buying or selling, especially on platforms based in other countries. DAC8 changes that: it requires crypto exchanges and platforms to report to the tax authority who is trading and how much.

And the best part (or worst, depending on how you look at it): EU countries pass that information to one another. So if you live in Spain but use a platform from another European country, that data will eventually reach the Spanish tax agency. It is the EU's way of saying “no more hiding crypto from the taxman.”

What is it? - PRO

DAC8 is Council Directive (EU) 2023/2226 of 17 October 2023, which amends Directive 2011/16/EU on administrative cooperation in the field of taxation for the eighth time. It introduces a framework for the automatic and mandatory exchange of information on crypto-assets, aligned with the OECD Crypto-Asset Reporting Framework (CARF).

It requires crypto-asset service providers to report tax information on their users and transactions, covering both those authorised under MiCA (MiCA Regulation (EU) 2023/1114) and other crypto-asset operators. The transposition deadline expired on 31 December 2025, and the reporting obligations apply from 1 January 2026, with automatic exchange between tax administrations from 2027. In Spain, its transposition is implemented through the corresponding royal decree and implementing ministerial order.
