# Travel Rule

**The travel rule is the requirement that a crypto-asset transfer between providers carries data on who sends it and who receives it, so that the information «travels» with the funds.** It comes from FATF Recommendation 16 on wire transfers, which the FATF applies in modified form to virtual asset service providers (GAFILAT guide, August 2023). In the European Union it is imposed by Regulation (EU) 2023/1113, applicable since 30 December 2024 (art. 40), which according to its recital 6 applies FATF Recommendations 15 and 16 uniformly.

**What data the EU requires.** The originator's crypto-asset service provider must ensure the transfer carries (art. 14):

- **On the originator:** name; distributed ledger address and crypto-asset account number, if any; address, official identity document number and customer number or, alternatively, date and place of birth; and the LEI code, if available (art. 14(1)).
- **On the beneficiary:** name; distributed ledger address and account number, if any; and the LEI code, if available (art. 14(2)).

The information is sent securely before or at the same time as the transfer, and need not be embedded in it (art. 14(4)). The originator's provider verifies the originator's data against reliable, independent sources (art. 14(6)) and may not execute the transfer without complying with the article (art. 14(8)). The beneficiary's provider applies procedures to detect missing information (art. 16(1)).

**Self-hosted wallets and exceptions.** If the destination or origin is a self-hosted address, the provider obtains and keeps the information and, above 1,000 euros, takes measures to assess whether that address is owned or controlled by its customer (arts. 14(5) and 16(2)). The regulation does not apply to person-to-person transfers without a provider (art. 2(4)). It sets no minimum amount for crypto-asset transfers: its art. 37 asks the Commission to assess whether thresholds should be introduced.

**In Latin America.**

- **Argentina:** UIF Resolution 49/2024 requires PSAVs (virtual asset service providers) to identify the originator and beneficiary of transfers in line with FATF standards (art. 37), with no amount threshold.
- **Costa Rica:** art. 15 quater of Law 7786, added by Law 10961, requires providers to obtain and keep the FATF-standard information on incoming and outgoing transfers.
- **Mexico:** those exchanging virtual assets as a vulnerable activity must obtain, keep and make available to the authorities the information on the originator, the recipient and, where applicable, the beneficial owner (art. 17(XVI) of the LFPIORPI, paragraph added on 16 July 2025).
