# Asset tokenization in Peru: securitisation trusts, the SMV and the SBS AML perimeter

**Peru has no crypto-asset law, but it does have the vehicle tokenization needs: the securitisation trust (fideicomiso de titulización), run by securitisation companies supervised by the SMV.** Crypto regulation arrived through the compliance door — virtual asset service providers are obliged entities for anti-money laundering before the SBS — and securities follow the Securities Market Law.

## The framework: SMV, SBS and a compliance-based perimeter

The **Securities Market Superintendence (SMV)** supervises the issuance and trading of securities; the **SBS** supervises banking, insurance and pension funds. There is no specific crypto-asset law and no licensed VASP registry: what exists is the inclusion of virtual asset service providers as obliged entities for anti-money laundering (PLAFT) — comply, report, identify. A tokenized security is a security: the Securities Market Law and SMV supervision apply.

## The vehicle: the securitisation trust

Peru has a figure tailor-made to fractionalise assets to securities-market standards: the **securitisation trust**, administered by securitisation companies authorised by the SMV, which issues securities backed by the trust estate. Alongside the banking trust of the banking law, it is the Peruvian variant of the Latin American [fideicomiso](/en/glosario/fideicomiso) — and the one that best fits representing those securities in tokens with transfer restrictions and a register a regulated entity answers for.

## What is being tokenized

Real estate (projects and rental income), invoices and receivables — Peru has a highly developed factoring and negotiable-invoice culture — and export agribusiness. The reading for an issuer: securitisation already solves half the problem; tokenization brings the other half (fractionalisation, modern settlement, transferability) without leaving the supervised perimeter.
